Gay Students May Sue Over Campus Housing

NEW YORK — Gay and lesbian students at Yeshiva University have the right to sue the Orthodox Jewish university in an effort to live together in school dormitories, New York’s highest court ruled.
The decision by the Court of Appeals overturns earlier lower court decisions that dismissed the suit, and allows the students to sue under New York City’s antidiscrimination law.
The school had argued that the housing policy does not discriminate against gays because unmarried heterosexuals are also not allowed to live together. Two lesbian students who filed for campus housing with their female partners were turned down.
