A 52-year-old federal law that prohibits firms from listing alcohol content on beer labels and advertisements is unconstitutional, the Justice Department said, and it will not defend or enforce the statute. Responding to a suit filed three months ago in U.S. District Court in Denver by Golden, Colo.-based Adolph Coors Co., the department said that the ban violates the free speech clause of the First Amendment. Coors contends in the suit that it is at a disadvantage in the marketplace because it is prohibited from listing alcohol content on its products and that the law violates freedom of speech guarantees. Congress has until Nov. 12 to intervene in the case if it objects to the Justice Department’s stance.
