Some time in the next year, the U.S. Supreme Court will take up the role of King Solomon in deciding which of two parents should have custody of their child--and which of the two states they live in has jurisdiction.
The court has agreed to consider whether a California court order, issued on behalf of Dr. David Thompson of Los Angeles, granting him custody of his 9-year-old son Matthew, takes precedence over a previous order, issued by a court in Louisiana to his estranged wife, Susan Clay, granting her custody. Thompson is represented by Ronald W. Weiss of Tustin.
Watching from the sidelines, among others, are the states of Hawaii, Nevada and Texas--states which requested the court accept the matter for review. The decision could affect the estimated 100,000 children who are abducted by a divorced or separated parent each year.
